These Terms of Service ("Terms") govern your access to and use of ToteForge (the "Service"), operated by [CONFIRM: legal entity name, e.g. "Jane Smith d/b/a ToteForge" or an LLC/corp name] ("ToteForge," "we," "us," or "our"). By using the Service, paying a build invoice, or subscribing to a plan, you ("you," "your," or the "Operator") agree to these Terms. If you do not agree, do not use the Service.
ToteForge is a software platform for running a reusable-tote (or similar) rental business: a branded booking site, inventory and scheduling, logistics, coupons, document signing, and related tools. For most operators we also provide one-time design and setup services as part of a build: branding, imagery, website design, and platform configuration. Beyond those services, ToteForge is a software provider only. We are not a party to, and have no responsibility for, the rental transactions between you and your own customers. You are solely responsible for your business, your pricing, your customer agreements, and compliance with laws that apply to your business.
Accounts are created for you as part of your build. You must provide accurate information and keep your login credentials confidential. You are responsible for all activity that occurs under your account. Notify us immediately at [CONFIRM: support/legal contact email] if you suspect unauthorized access.
Every build is quoted individually before any work begins. The build fee is a one-time charge, collected through a secure Stripe Checkout link we send you. That same checkout stores your payment method with Stripe and starts your monthly subscription; your first monthly charge occurs after the build period shown at checkout. The exact amounts and dates are displayed on the payment page before you pay.
Paid subscriptions are billed monthly in advance on your subscription's billing date, using the payment method on file, and automatically renew each month until cancelled. Prices are shown to you before you pay and in your dashboard's Billing & Plan screen; we will make reasonable efforts to notify you of price changes before they take effect. Applicable taxes may be added where required by law. Charges may appear on your statement under Molten Agency, the company behind ToteForge.
ToteForge's subscription charges are separate from, and unrelated to, any payments your own customers make to you; those go directly to your own Stripe (or other) account, and ToteForge never holds or has access to your customers' funds.
You may cancel your subscription at any time, self-serve, from Billing & Plan in your dashboard, no need to contact anyone. Cancellation takes effect at the end of your current billing period, and you will not be charged again after that period ends; access continues until then.
Monthly subscription charges that have already been processed are generally non-refundable, including for partial billing periods. Build fees pay for design and configuration work and are generally non-refundable once that work has begun. We may, at our sole discretion, issue a full or partial refund in specific circumstances (for example, a billing error on our part). Refund requests can be sent to [CONFIRM: support/legal contact email]; approval is not guaranteed.
You agree not to: use the Service for any unlawful purpose; misrepresent your business or identity; attempt to bypass, disable, or interfere with the security or normal operation of the Service; resell or provide the Service to third parties as your own SaaS product; upload content you do not have the right to use; or use the Service to send unsolicited communications in violation of applicable law (including SMS/email marketing laws).
You retain ownership of your business content (branding, pricing, customer records, blog posts, and similar data you create or upload). Every operator's data is technically isolated from every other operator's data. We access your account only to provide support you request, to maintain the Service, or as required by law. See our handling of payment data in Section 9.
The Service integrates with third-party providers you may choose to connect, including Stripe (payments), SignWell (document signing), and email delivery providers. Your use of those providers is subject to their own terms and privacy policies. ToteForge is not responsible for the acts or omissions of third-party providers.
ToteForge and its software, design, and branding are owned by us and are protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding beyond what is needed to use the Service as intended.
We may suspend or terminate your account for violation of these Terms, non-payment, fraudulent or abusive activity, or as required by law. You may stop using the Service and cancel your subscription at any time as described in Section 5. Upon termination, your right to access the Service ends; we will make reasonable efforts to allow you to export your data beforehand where feasible.
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the Service will be uninterrupted, error-free, or secure at all times.
To the maximum extent permitted by law, ToteForge and its owners/operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the [CONFIRM: liability cap period, e.g. "12 months"] preceding the claim.

Each build quote and checkout reflects the exact pricing in effect at that moment, regardless of later changes.
